Regarding the timing for assessment and placement of Special Education Services:
From Commissioner's/SBOE Rules:
$29.004 Comprehensive Assessment:
A written report of a comprehensive individual assessment (CIA) of a student for purposes of special education services shall be completed not later than the 60th calendar day following the date on which the referral for assessment was intiated by school personnel, the student's parent or legal guardian, or another appropriate person. The assessment shall be conducted using procedures that are appropriate for the student's most proficient method of communication.
$89.1050 The Admission, Review and Dismissal (ARD) Committee Time Line.
The admission,review and dismissal (ARD) committee shall make its decisions regarding students referred for the first time within 30 calendar days from the date of the completion of the written assessment report. If the 30th day falls during the summer and school is not in session, the ARD committee shall have until the first day of classes in the fall to finalize decisions concerning placement and the individual educational plan (IEP), unless the assessment indicates the student will need extended year services during that summer.
